Crime and Courts Thursday, May 3, 2012 2nd Dimora trial in doubt Dept. of Justice will decide by WKSU's MARK URYCKI |
 Senior Reporter Mark Urycki | | |
In The Region: Attorneys for former Cuyahoga County Commissioner Jimmy Dimora have filed a request that his second trial scheduled be delayed. They want to wait to see whether Justice Department decides to dismiss the case altogether. WKSU’s Mark Urycki has details |
Jimmy Dimora is awaiting sentencing after being indicted in March on 33 charges of corruption in office. He faces another trial in October along with friend and contractor Michael Forlani. Dimora’s lawyers have so far been unsuccessful in arguing that the second trial represents double jeopardy.
Now Assistant US Attorney Antoinette Bacon has indicated the prosecution’s trial team has asked their bosses at the Justice Department to drop the second trial against Dimora. And she wrote a letter to Dimora attorney Andrew Whitaker informing her that they would not object to at least delaying that October trial until the government makes a decision. Bacon said they understand that the defense does "not want you client to needlessly expend resources " preparing for a trial that may not happen. Dimora has now filed a motion with federal judge Sara Lioi to delay that October trial. He is faces sentencing in July and is expected to appeal his conviction. |
